Extension of Lien
Overview of Extension of Lien
An "Extension of Lien" is a document that is filed to extend the time that a person has to enforce a construction lien with a foreclosure lawsuit. Most states require the claimant to enforce the construction lien within a limited time frame. After the stated time frame, the lien is deemed expired by operation of law. Below is a brief summary of the lien extension laws for California and Nevada.
- In California, a claimant can only enforce the lien within 90 calendar days from the date that the lien was filed. However, according to Cal. Civ. Code Section 8460, the lien can be extended for up to one (1) year from the date the job was completed. The contractor and the property owner must agree and sign the lien extension. The extension of lien must be filed within 90 days from the date the original lien was filed OR before a purchaser or encumbrancer acquires right in the property, whichever occurs first.
- In Nevada, a claimant can only enforce the lien within 6 months from the date that the lien was filed. However, according to N.R.S. Section 108.233, the lien can be extended for up to one (1) year from the date the original lien was filed. The contractor and the property owner must agree and sign the lien extension.
