Terms and Conditions of Use

Your use of this site and/or any of the products or services offered on our site (collectively, the "Services") is subject to these Terms and Conditions of Use (these "Terms"). We may modify these Terms at any time without notice to you, but by posting revised Terms on our sites. Your use of our site constitutes your binding acceptance of these Terms, including any modifications that we make.

Some of the Services may be subject to additional posted conditions. Your use of those Services is subject to those conditions, which are incorporated into these Terms by reference. In the event of an inconsistency between these Terms and any additional posted conditions, the provisions of the additional conditions shall control.

Processing and Filing Time Frame: When FREE Second Day Preparation is offered, documents shall be prepared and delivered to you for review within 2 business days, however, this time frame is not guaranteed (if delivered by mail, the 2 business days does not include transit time). Preparation services may be delayed if our staff is missing information, locates inconsistencies and/or errors, or if there is there is an uncontrollable circumstance.

When "Expedited Filing Service" is offered, your document shall be hand filed over the counter or electronically filed with the appropriate government agency within approximately 3 to 5 business days from the date we receive your signed documents (filing confirmations are mailed and is subject to USPS delivery times). Some government agencies require documents to be dropped off and picked up at a later time. Pick up times are set by the government agency and we cannot make any promises for the filing time frame. Our "Regular Filing Service" is defined as the filing your documents with the appropriate government agency by mail.

Delays are uncommon for both our preparation and filing services, but may occur due to uncontrollable circumstances which includes, but is not limited to, fires, floods, storms, earthquakes, civil disturbances, disruption of telecommunications, transportation, utilities, services or supplies, governmental action, computer disruption, data corruption, incompatible or defective equipment, software or services or otherwise. My Legal Depot will not be liable for any damages or loss resulting from any delays of service.

Research, Review, Reporting of Errors: My Legal Depot will make every reasonable effort to check and verify the information that you submit against public and private databases for errors and/or inconsistencies. However, since all public and private databases are deemed accurate but not guaranteed, My Legal Depot will not guarantee accuracy. Any public or private data that we obtain during research and/or verification is on an "as is" basis.

Any errors, inconsistencies, and/or omissions made on the completed document, whether the cause was derived from incorrect information furnished by the customer or was created during My Legal Depot’s processing shall be corrected in the following manner: (a) If an error is discovered and brought to My Legal Depot’s attention prior to the signing and filing of the document, My Legal Depot shall make the requested correction within two business days at no extra charge; or (b) If the errors are discovered AFTER the documents are signed and/or filed, additional processing and/or filing fees to make the requested corrections may apply.

Although we employ several tools and procedures to locate and fix errors before the documents are delivered, it is the ultimate responsibility of the customer, document signer, and recipient of the document to conduct a thorough review and report all errors to My Legal Depot prior to signing the documents. My Legal Depot will not be liable for any damages or loss resulting from any errors, inconsistencies, and/or omissions.

Business/Corporate Name Filing: My Legal Depot will perform a preliminary name search of your proposed business/corporate name when required. This search is only intended as a basic preliminary search for confusingly similar names and does not guarantee that the name is available for exclusive use or that it complies with city, state, and federal laws. My Legal Depot will not be liable for any damages or loss resulting from any claims as a result of your business/corporate name filing. The customer is ultimately responsible in verifying that the business/corporate name being selected for registration is unique and that it complies with all applicable laws.

Registered Agent Services: If you subscribe to our registered agent service, My Legal Depot Inc. or a third-party provider of our choice will serve as your Registered Agent to receive any services of process including, but not limited to, any legal notice and/or official government communication. Upon receipt, we shall notify and deliver such notices to you in a timely manner through one of the following methods: (1) scanning and uploading the notices to your account, or (2) faxing the notice to your entity, or (3) attaching and emailing the scanned notice. Afterwards, you may request us to forward the originals to an address that you specify or for us to shred and discard the envelope and its contents. If no forwarding requests are made within 90 calendar days, all originals will be discarded Additional delivery costs may apply for any original document or notices forwarded to your entity. You also agree to keep us notified in a timely manner of any changes to your mailing address, phone/fax numbers, and email address.

Futhermore, you agree not to use or misrepresent the registered agents address as your entity's place of business, mailing address, or publish the address on any media including, but not limited to, business cards, flyers, or other advertisements. The role of a registered agent is merely to accept and forward various legal or government notices to you and any unauthorized use may result in the termination of service. My Legal Depot Inc. or its third-party providers shall resign as the registered agent and terminate service upon the dissolution of your entity, failure to renew the registered agent subscription, or under the unauthorized usage of our registered agent services.

Authorized Representative: If you are using our service to prepare and serve Pre-Liens, Notices of Intent to Lien, Stop Notices, Miller or Little Miller Act Notices, and/or any other construction related notice, you hereby designate and appoint My Legal Depot and its employees as your Authorized Agent and thereby give us authority to sign and serve the above-described notices.

Use of Forms: The products available for purchase from My Legal Depot, including, but not limited to, "fill in the blank" forms and fully prepared documents, cannot be reproduced, transferred, or sold to other persons without our written consent. My Legal Depot grants you a non-exclusive license to use the products for your personal use only, or if you are an attorney or other professional, for the client for whom the product was purchased. Furthermore, you understand that the products and any included instructions is not legal advice or the practice of law.

Right to Refuse Service: My Legal Depot reserves the right to refuse service to anyone. My Legal Depot will not be liable for any damages or loss from our right to refuse service.

Cancellation Policy: Any order that is cancelled prior to the researching, preparing, delivering, or filing of your legal document is entitled to a full refund. If service has already commenced, we will issue a partial refund in the amount of your purchase price minus any reasonable processing costs incurred. However, if your documents have been fully completed and/or filed, no refund will be issued. To cancel a pending order, please send a cancellation request by email to: Support@MyLegalDepot.com or contact our Customer Support Department at 800-820-2144.

Returned Checks and Chargebacks: A $35.00 dollar fee will be added to all returned checks. Full restitution or payment arrangements must be made within 15 calendar days from the date of notification otherwise your account will be sent to a collection service. If your account is sent to collections, you will be billed for collection fees plus any other costs incurred as a result of the returned check.

A $45.00 dollar fee will be added to any chargeback attempt on a credit card purchase. A chargeback occurs when a cardholder contacts his/her bank to request a reversal on a credit card purchase before contacting the merchant. Full restitution or payment arrangements must be made within 15 calendar days from the date of notification otherwise your account will be sent to a collection service. If your account is sent to collections, you will be billed for collection fees plus any other costs incurred as a result of the chargeback.

Limitations of Use: All material published on our site, including, but not limited to, written content, photographs, graphics, images, illustrations, marks, logos, flash animation, and other content contained herein, are the property of My Legal Depot and is protected by the United States and international copyright law. All rights to such materials are reserved to their respective copyright owners.

Permission is granted to download, view, copy, and to print in hard copy portions of this web site solely for personal, informational, and non-commercial uses. Any other use of materials on this site, including without limitation reproduction for purposes other than noted above, modification, distribution, replication, commercial or other exploitation, or creation of derivative works, without the prior written permission of My Legal Depot is strictly prohibited.

Limitation of Liability: My Legal Depot is not liable for any injury, claim, liability, or damage of any kind resulting from the use of this site including, but not limited to, legal document preparation and filing services. My Legal Depot’s liability is limited only to the amount paid to My Legal Depot. If you are not satisfied with our service please contact our Customer Support Department at 800-820-2144 and we will take every reasonable effort to provide you with satisfaction.

Severability: If any part of these Terms is determined to be invalid or unenforceable pursuant to applicable law, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the Terms shall continue in effect.

Venue: This agreement shall be governed by the laws of the State of California. Since My Legal Depot provides no warranties and limit our liabilities, there should be little reason to have a grievance with us. However, should a legal action be brought, you and My Legal Depot exclusively and irrevocably agree it shall be instituted in a state or federal court in California, and in the County of Los Angeles, within one (1) year after such claim or cause of action arose or be forever barred. As a disincentive for unwarranted litigation, you and My Legal Depot agree that if you sue us and do not win, you will pay for our defense costs, including, but not limited to, reasonable legal fees for both in house and outside counsel.

Acceptance: By using this site and/or any services related herein, you agree that you have read, understand, and agree to the terms and conditions of use.
