Design Professional / Claimant - Your Company Information

California Civil Code § 8300 only allows certificated architects, landscape architects, registered professional engineers, or licensed land surveyors to file a design professionals' lien. Other design professions are not protected under this rule.

WARNING - Residential Projects:

California Civil Code § 8318 does NOT allow design professionals to file liens against residential owner-occupied homes where construction costs are less than $100,000.00 in value. This does NOT apply to commercial properties, rental properties, investment properties, and other properties where the owner does not live on the property.


WARNING - Demand/Intent to Lien Notice Required:

California Civil Code § 8304(c) requires a demand/intent to lien notice to be served by certified or registered mail to the property owner 10 days prior to the filing of a lien. This interim notice is required for all claimants who wish to file a design professionals' lien.

If you have not complied with this rule, please place an order for the "Notice of Intent to Lien" before filing the actual lien.

Building Permit or Other Government Approval

WARNING - Building Permit or Other Approval Required

California Civil Code § 8302(c) requires that a building permit or other governmental approval which allows the furtherance of work on the project to be obtained before a design professional's lien can be filed.

A design professionals' lien can only be filed if a building permit or other approval document has been issued. Please provide the permit information below:

Contract Details

The total amount of furnished or completed work, materials MINUS the total amount of payments received EQUALS the amount of your claim. Bond claims can only be placed for the actual value of work, materials, or equipment that was furnished and/or completed.

(Example: If you complete only 75% of the project, then you can place a claim for 75% value, but NOT the remaining 25% because it remains uncompleted)

California Civil Code § 8300 requires the Design Professional/Claimant to have a direct contract with the property owner for their services. In order to file a design professionals' lien, you must have a contract with the owner otherwise you cannot file this lien but may instead file a construction/mechanics' lien if actual construction has commenced.

Special Note

Effective January 1, 2018, the California Senate passed Senate Bill 2 which adds an additional $75.00 filing fee for each real estate related document filed. This fee is levied per property, per document title. Once we complete the title research, our team will notify you if there are any additional fees due. You will have an opportunity to cancel if you decide not to proceed. Most of the time, there are no additional fees due.

Certified Copy of Filing

A certified copy is an "official copy" issued by the government agency. The certified copy has a special stamp which certifies your filed documents as a "true and correct copy." We recommend that you purchase a certified copy for your own records.

There is an additional $35.00 fee for each certified copy. It is not required, but we recommend that you purchase one for your own records.
